Roche's Cancer Drug Patent Partly Revoked in India

A company spokesperson it has received notification from the Kolkata Patent Office on July 17 that it has lifted divisional patents for Herceptin as they were not properly submitted.

The announcement comes just a few days after India revoked GlaxoSmithKline's patent for its breast cancer drug Tykerb.

"I can confirm that the Assistant Controller of Patents at the Kolkata Patent Office has revoked divisional patents of Herceptin and that we are now considering the further course of action", a spokesman for Roche said.
